For a minor or a patient needing assistance in understanding these rights, both the patient and the parent, legal guardian, or another responsible person will be fully informed of these rights to their satisfaction.
If a patient cannot read the statement of rights and responsibilities, it will be read to the client/patient and a copy will be provided in a language they understand.
Patients who have been adjudged incompetent under state law by a court of proper jurisdiction will have their rights exercised by the person appointed to act on their behalf. If a state court has not adjudged a patient incompetent, any legal representative designated by the patient following state law may exercise the patient's rights to the extent allowed by state law.
Any violation of customer rights will require an incident report to be completed by the employee.
The notice of patient rights and responsibilities will be available to others in the community upon request.
Annual education on patient rights and responsibilities will be provided to all personnel.
The statement of patient rights and responsibilities includes, but is not limited to, the following:
Be fully informed in advance about care/service to be provided, including the disciplines that furnish care and the frequency of visits, as well as any modifications to the plan of service
Be informed in advance of care/service being provided and patient financial responsibility
Receive information about the scope of services that the organization will provide and specific limitations on those services
Participate in the development and periodic revision of the plan of service
Refuse care or treatment after the consequences of refusing care or treatment are fully presented
Have the patient’s property and person treated with respect, consideration, and recognition of the patient’s dignity and individuality
Be able to identify visiting personnel members through proper identification
Be free from mistreatment, neglect, or verbal, mental, sexual, and physical abuse, including injuries of an unknown source, and misappropriation of patient property
Voice grievances/complaints regarding treatment, care, or lack of respect of property, or recommend changes in policy, personnel, or care/service without restraint, interference, coercion, discrimination, or reprisal
Have grievances/complaints regarding treatment or care that is (or fails to be) furnished, or lack of respect of property investigated
Confidentiality and privacy of all information contained in the patient record and of Protected Health Information (PHI)
Be advised on the agency's policies and procedures regarding the disclosure of clinical records
To transfer services to another provider or facility without restraint, interference, coercion, discrimination, or reprisal
Receive appropriate care without discrimination in accordance with physician’s orders
Be informed of any financial benefits when referred to an organization
Be fully informed of patient’s responsibilities
